1. Acceptance of Terms
By accessing or using any services provided by Enthelot Hosting, you agree to be legally bound by these Terms of Service. If you do not agree, you must not use our services.
2. Services Provided
Enthelot Hosting provides services including, but not limited to:
Web hosting
Domain name registration
Email hosting
Server space rental
Website backups and maintenance
Service features, limits, and billing cycles are defined in the client’s selected plan, invoice, or service agreement.
3. Cancellation & Early Termination Policy
All hosting services are offered on a contractual billing cycle (monthly, annual, or multi-year).
Advance Cancellation Requirement
Clients on annual or long-term plans must submit a written cancellation notice at least thirty (30) days prior to the next billing or renewal date.
Early Termination Fee
If a client:
Cancels after the start of an annual or long-term billing cycle, even if the service period has commenced by one (1) day, or
Fails to provide the required 30-day advance written notice,
then the client agrees to pay an Early Termination Fee equal to forty percent (40%) of the total package value for the active billing term.
Non-Refundability
The 40% cancellation fee is mandatory and non-negotiable.
Any remaining balance, if applicable, must be settled before account closure.
No refunds will be issued for unused service time unless explicitly stated in writing by Enthelot Hosting.
This policy aligns with industry-standard SaaS and hosting practices and is necessary to cover infrastructure, licensing, and administrative commitments incurred at service activation.
4. Payments
All payments must be made exclusively through:

Payments are due according to the agreed billing cycle. Failure to pay on or before the due date will result in automatic service suspension.
5. Non-Payment and File Deletion Policy
In the event of non-payment:
Services will be suspended after the due date.
After thirty (30) days of non-payment, all files, websites, emails, and backups will be permanently deleted without further notice if no prior communication has been made.
This action is irreversible, and Enthelot Hosting bears no liability for data loss resulting from non-payment.
6. Client Responsibilities
Clients are responsible for:
Maintaining accurate and up-to-date contact information
Regularly backing up their own data
Using services strictly for lawful purposes
Ensuring timely payment to avoid service disruption
7. Use of Services
Clients may not use Enthelot Hosting services to:
Host or distribute malware, phishing content, or illegal material
Engage in spam, hacking, or network abuse
Violate intellectual property rights or Kenyan law
Violations will result in immediate termination without refund.
8. Privacy and Data Protection
We process personal data strictly for service delivery, billing, and account management, in compliance with the Kenya Data Protection Act, 2019.
9. Limitation of Liability
Enthelot Hosting shall not be liable for:
Loss of income, business, data, or clients
Downtime caused by third-party providers, maintenance, or force majeure
Any damages exceeding the amount paid for services in the preceding thirty (30) days
Services are provided “as is” and used at the client’s own risk.
10. Intellectual Property
Clients retain ownership of their content. However, clients grant Enthelot Hosting limited rights to host, store, back up, and technically display such content as required to provide services.
11. Service Termination
Clients may terminate services subject to Section 3.
Enthelot Hosting reserves the right to suspend or terminate services for:
Non-payment
Abuse or violation of these terms
Illegal or unethical activity
No refunds apply in cases of termination for breach.
12. Force Majeure
Enthelot Hosting is not liable for service delays or failures caused by events beyond reasonable control, including natural disasters, power outages, government actions, or internet failures.
13. Amendments
We reserve the right to amend these Terms of Service at any time. Continued use of services constitutes acceptance of the updated terms.
14. Dispute Resolution
Disputes shall be resolved amicably where possible. Failing that, disputes will be settled through arbitration in Nairobi, governed by the Arbitration Act of Kenya, under Kenyan law.
